Please read BaliBagus.com's Terms & Conditions and Privacy
Policy carefully before accessing the Reservation Management System and
getting many "cutting cost" offers such as Special Offer, Super
Saver and Tour Packages.
Definition
A Member is a person who sign up to BaliBagus.com's Reservation
Management System and will use any services and products offered by
BaliBagus.com.
BaliBagus.com is a company that provides, operates and responsible
for the Reservation Management Systems ("RMS").
Benefit of the Services
Member is offered products and services ie access to the database
provided by BaliBagus.com. An email will be sent to Member
about the details.
Description of the Services
BaliBagus.com provides the most extensive database available for
related tours and travel services and accommodations including: hotels,
resorts, villas, bungalows, cottages, private villas and so on. Member
has unlimited access to the database and can make particular deals for
particular services with BaliBagus.com.
Member, Account and Password
Everyone can be a member of BaliBagus.com's RMS. Every member has
an account (called log in name and password). Please note that both log
in name and password are case sensitive ie case, Case and CASE are different.
Applicant Denial and Membership Termination
BaliBagus.com reserves the right to approve or reject any application
for membership with or without reasons and notices. BaliBagus.com
reserves the right to terminate an account due to the violation of rules
and regulations as stated in Terms and Conditions and other related rules.
If membership is terminated from database, Member cannot reapply
for membership at any time.
Illegal Copy and Distribution
It is illegal, dishonourable and a crime to copy and/or distribute database,
product, or service information or any materials without written permissions
from BaliBagus.com.
Registration Obligations
Member has to agree with the Terms and Conditions of this service.
Using Membership
Whenever Member use his/her membership BaliBagus.com's travel
consultant will recognize and give him/her full support. When Member
has a direct contact to BaliBagus.com's staff via phone the special
services will apply. BaliBagus.com's staff may ask for Member's
account (complete name and login name) but the password. Member
must log in to book a room using the reservation form of the intended
hotel.
Limitation of Liability
BaliBagus.com makes no responsibility and shall not be liable for any
damages to, or viruses that may infect Member's computer or other
property as a result of Member's access to, use of, or browsing
in this site and downloading of any contents from the site.
BaliBagus.com does not accept any liability for any injuries, losses,
claims, damages or any indirect or consequential loss of any kind in contract,
tort or otherwise arising out of the use of the website or for any products
or services purchased from BaliBagus.com. BaliBagus.com
does not guarantee the availability and/or quality of products and/or
services, accuracy of information provided by third parties.
PRIVACY POLICY
BaliBagus.com values Member's privacy. BaliBagus.com
only collect information that would normally be asked when Member
registering at any reputable hotel. Except when providing this information
to the hotel to reserve and confirm Member's reservation request,
BaliBagus.com does not currently and has no plan in the future
to sell, share, or rent any information that Member provided to
any other third party.
Force Majeure
Force majeure includes war, threat of war, riot, civil disobedience or
strife, industrial dispute, terrorist activity, natural or industrial
disaster, governmental regulations, communication or utility failures,
fire, adverse weather conditions, level of water in rivers, labour disputes
or disturbances, material shortages or rationing, technical or maintenance
problems with transfer, unforeseen operational decisions of air carriers
such as changes of schedule, or any unforeseeable or unavoidable event
beyond BaliBagus.com's control.
Alteration
BaliBagus.com reserves the rights to modify, add or remove portions
of the Terms and Conditions under which the website is presented
without Member's consent. Please check periodically for changes.
Member's continued use and/or access to web site following changes
to this Terms and Conditions will mean that Member accept those
changes.
Law of Agreement
This Agreement shall be governed by the laws of the Republic of Indonesia.
The regulations of the Republic of Indonesia shall rules any claims or
legal actions arising relating this agreement.
Reservation Procedures
All reservation will be proceeding if Member fills completely the
Reservation Form. The reservation will be reply within 2 x 24 hours. If
the reservation is not confirmed BaliBagus.com's staff will inform Member
and give the other suggestions. BaliBagus.com need Member's
credit card's number as only as a guarantee and it will not be charged
as a payment. BaliBagus.com will inform Member in a separate
email if any another details are required by hotels ie deposit for "Peak
Season Period".
Upon check-in date, Member shall present himself/herself personally,
his/her Generated ID (ie Proof of Purchase), Credit Card and other necessary
identification documents (passport) for the purposes of confirming his/her
identity and reservation to the relevant personnel at the hotel.
Payments
Payment shall be made directly by Member to the reserved hotel.
BaliBagus.com shall not be liable in any way if hotel refuses to
accept or honour the Credit Card for any reasons. Furthermore, BaliBagus.com
makes no responsibility to any surcharges made by Member's Credit
Card issuer and/or his/her partner Banks. Member need to check
his/her Credit Card issuer if he/she has any questions regarding this
matter.
Prices
Rates are quoted on per night per person basis and allow for maximum occupancy
of the hotel as shown on the web site.
Member can makes modifications/changes to his/her reservation by
sending email to BaliBagus.com. BaliBagus.com will make
a new reservation as per Member's request. BaliBagus.com
shall not be liable in any way if Member fails to secure previously
reserved room rates and/or period of stay at the same hotel.
Modifications/Changes
Member is liable for any additional charges or expenses imposed
by Hotel/Villas in respect to such modifications/changes for shortening
of stay and/or downgrading, extension of stay and/or upgrading of room
type or full cancellation based on hotel/villa current Cancellation Policy.
Refunds, if any, shall be made by hotel directly to Member based
on its current Refund Policies.
Additional Terms
Additional Terms and Conditions may apply to reservation, purchase of
services and other uses of portion of this site. Member agrees
to abide by such other Terms and Conditions.
